action. The judgment of the trial court is affirmed. No costs awarded. Plaintiff, a Utah corporation, hereinafter referred to as DeBry, or charterer, is engaged in all phases of the travel business.
Defendant, a Tennessee corporation, hereinafter referred to as Capitol, is a charter airline. DeBry sells package tours to
students. DeBry generally charters an aircraft for such a tour because a charter flight costs substantially less than a regularly
scheduled airline flight. Under C.A.B. regulations, DeBry is considered an indirect carrier, and both parties are subject
to the control and regulation of the C.A.B.
